Floor Amendment to SB 263-FN
Amend the title of the bill by replacing it with the following:
AN ACT relative to the New Hampshire granite advantage health care program and the commission to evaluate the effectiveness and future of the New Hampshire granite advantage health care program.
Amend the bill by inserting after section 7 the following new section and renumbering section 8 to read as 9:
8 New Hampshire Granite Advantage Health Care Program; Program Eligibility; Utilization of Benefits. Amend RSA 126-AA:2, II(a) to read as follows:
II.(a) To receive benefits under this section and to the extent allowed by federal law, the individual shall:
(1) Provide all necessary information regarding financial eligibility, assets, residency, citizenship or immigration status, and insurance coverage to the department in accordance with rules, or interim rules, including those adopted under RSA 541-A;
(2) Inform the department of any changes in financial eligibility, residency, citizenship or immigration status, and insurance coverage within 10 days of such change; [and]
(3) At the time of enrollment acknowledge that the program is subject to cancellation upon notice; and
(4) At the time of enrollment acknowledge that an under-utilization of benefits shall result in the termination of benefits upon annual re-verification and re-enrollment. For purposes of this section, a minimum utilization of benefits shall be defined as one annual physical examination with a licensed primary care provider within one year from the date of enrollment or annual re-enrollment. This annual physical examination frequency may be extended: (i) if the last visited primary care provider developed a care plan that does not require a physical examination visit in a given time frame; or (ii) if the individual made all reasonable steps to schedule a physical examination appointment, but was not able to get it scheduled in a given time frame for reasons beyond the individual’s control.

AMENDED ANALYSIS
This bill:
I. Reestablishes and revises the membership and duties of the commission to evaluate the effectiveness and future of the New Hampshire granite advantage health care program. The commission is repealed November 1, 2028.
II. Permanently extends the New Hampshire granite advantage health care program by removing the prospective repeal of the program that was to take effect on December 31, 2023.
III. Removes the transfer of funds from the alcohol abuse prevention and treatment fund to the granite advantage health care trust fund.
IV. Requires a minimum utilization of benefits to remain eligible for the granite advantage health care program.
