AN ACT relative to bear registration, federal duck stamps, and the transport of out of state lobsters and crabs.

AMENDED ANALYSIS

 

This bill:

 

I.  Requires the executive director of fish and game to set up bear registration stations.

 

II.  Allows valid federal duck stamps to be confirmed using digital and electronic means.

 

III.  Requires a non-commercial landing license for non-residents transporting in state waters lobsters and crabs taken outside the jurisdiction of the state.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to bear registration, federal duck stamps, and the transport of out of state lobsters and crabs.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

276:1  New Paragraphs; Bear Registration.  Amend RSA 208:22 by inserting after paragraph VI the following new paragraphs:

VI-a.  The executive director shall cause to be established such number of bear registration stations as the executive director may deem necessary for the purpose of registering bear killed in the state. Each such station shall be in charge of an agent designated by the executive director. Annually, a list of such agents and the location of registration stations shall be published in the Hunting Digest.

VI-b.  The bear registration agent shall register each bear legally presented for registration and shall attach a registration seal to each bear in the manner prescribed by the executive director. The executive director shall adopt rules pursuant to RSA 541-A relative to registration agent fees.

276:2  Taking; Federal Duck Stamp Required.  Amend RSA 209:6, II to read as follows:

II. No person who has attained the age of 16 years shall take any migratory waterfowl (brant, wild ducks, geese and swans) unless at the time of such taking he or she has on their person an unexpired federal migratory bird stamp (commonly called a duck stamp) validated by his or her signature written across the face of said stamp in ink, or confirmation, including digital confirmation, of [an] a current and valid electronic migratory bird hunting and conservation stamp[, purchased within the previous 45 days]. A person who has not attained the age of 16 years is not required to have a duck stamp. Said duck stamp shall be required in addition to a valid New Hampshire hunting license obtained pursuant to RSA 214:1. Regulations promulgated under the Federal Migratory Bird Hunting Stamp Act of 1934 are hereby made a part of the game law of the state.

276:3  Landing License; Lobsters and Crabs.  Amend RSA 211:49-d to read as follows:

211:49-d Landing License; Lobster and Crabs.

I. Any person who is not licensed under RSA 211:18, RSA 211:49-a, or RSA 211:49-b and wishes to transport in state waters lobsters and crabs taken outside the jurisdiction of the state via ship, vessel, or similar craft in state waters for the purposes of landing the lobsters and crabs in the state must first procure a landing license. This shall allow the licensee to sell lobster and crab landed under such person's license. The fee for annual licenses for residents and nonresidents shall be set by the executive director pursuant to RSA 206:10, I.

II.  Any non-resident who transports in state waters lobsters and crabs taken outside the jurisdiction of the state via ship, vessel, or similar craft for the landing of the lobsters and crabs in the state, for personal use shall procure a non-commercial landing license at a rate set by the executive director pursuant to RSA 206:10, I.  Any person holding a commercial license in another jurisdiction or federal permit for the taking of lobster or crabs shall not be eligible for this license.  A person convicted of violating any provision of this section shall be guilty of a violation if a natural person and a misdemeanor if any other person.

276:4  Effective Date.  This act shall take effect 60 days after its passage.
