ANALYSIS

 

This bill provides that if a person requests a consumer report in connection with a transaction secured by real estate, the consumer reporting agency shall not release the report to a third party unless the consumer has a relationship with the third party or the consumer has consented to such release.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT limiting re-disclosure of consumer reports requested in connection with a credit transaction involving an extension of credit secured by real estate.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Consumer Reporting Agencies; Permissible Purposes of Reports; Release of Report to Third Parties Limited.  Amend RSA 359-B:4 by inserting after paragraph III the following new paragraph:

IV. If a person requests a report from consumer reporting agency in connection with a credit transaction involving an extension of credit secured by real estate, such agency may not, solely on the basis of such request, furnish a report to a third party unless such third party has submitted documentation to such agency certifying that such third party has the consumer's consent or has a current relationship, relating to credit, servicing or other financial services, with such consumer.

2  Effective Date.  This act shall take effect January 1, 2025.
