Floor Amendment to SB 335-FN

 

Amend the title of the bill by replacing it with the following:

 

AN ACT relative to the display of alcohol and alcohol packaging.

 

Amend the bill by replacing all after the enacting clause with the following:

 

1  New Paragraph; Display of Wine and Other Beverages.  Amend RSA 179:31 by inserting after paragraph XIII the following new paragraph:

XIV.  Licensees who sell alcoholic beverages for off-premises consumption and display such alcoholic beverages outside a clearly discernible location reserved for alcohol sales shall:
(a)  Not place alcoholic beverages in an area immediately adjacent and directly touching or bordering one another from above, below, or the side of nonalcoholic beverages containing the same or similar brand name, logo, or packaging as the alcoholic beverage.  In this paragraph, "immediately adjacent" shall not include a separate aisle;

(b)  Display signs that indicates the alcoholic beverage contains alcohol.  Such signs shall be clearly visible to customers and of sufficient size to notify the customer that the product or products contain alcohol; and

(c)  Not place alcoholic beverages in an area immediately adjacent and directly touching or bordering one another from above, below, or the side of any items that are marketed towards minors.

2  Advertising Restrictions.  Amend RSA 179:31, VII(b) to read as follows:

(b)  Any subject matter [or], illustrations, or packaging and labeling with attributes that are consistent with products marketed towards minors that the commission determines is reasonably likely to induce minors to drink. All coupon offers requiring consumer participation shall contain reference that the coupon offer is available only to persons of legal drinking age.

3  Effective Date.  This act shall take effect upon its passage.

AMENDED ANALYSIS

 

This bill restricts the display of alcoholic beverages near similarly labeled non-alcoholic beverages.

 

This bill also further restricts the design and packaging of alcoholic beverages.
