ANALYSIS

 

This bill establishes a class B misdemeanor for a state officer or employee to knowingly make a false statement to a member of the public during the performance of the officer's or employee's official duties, subject to certain exceptions.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to misrepresentation by state employees.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 New Section; Criminal Code; Falsification in Official Matters; False Statement by State Officer or Employee.  Amend RSA 641 by inserting after section 8 the following new section:

641:9  False Statement by State Officer or Employee.

I.  Except as provided in paragraph II, any person who is an officer or employee of the state shall be guilty of a class B misdemeanor if the person knowingly makes a false statement to a member of the public in the course of that person's official duties as an officer or employee of the state.

II.  This section shall not apply:

(a)  In any case where the false statement was justified pursuant to the competing harms standard as defined in RSA 627:3.

(b)  In any case where the false statement was made by a law enforcement officer.

2  Effective Date.  This act shall take effect January 1, 2025.
