STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to defining "critical habitat".

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Endangered Species Conservation Act; Critical Habitat.  Amend RSA 212-A:2 by inserting after paragraph V the following new paragraph:

VI. “Habitat determined to be critical” means a geographical area of land or waters designated by the executive director of the department that currently provides or historically provided physical or biological features essential to the conservation of an endangered or threatened species.

2  Conservation Programs.  Amend RSA 212-A:9, I to read as follows:

I. The executive director shall establish such programs, including acquisition of land or aquatic habitat or interests therein, as are deemed necessary for the conservation of endangered or threatened species, either within the current or projected future range of a species. The executive director shall utilize all authority vested in the fish and game department to carry out the purposes of this section.

3  Effective Date.  This act shall take effect 60 days after its passage.
