This bill establishes a disproportionate share hospital fund in the department of health and human services for the purpose of distributing funds to hospitals for completion of federally required disproportionate share hospital examinations.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT relative to establishing the disproportionate share hospital fund.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 State Treasurer; Application of Receipts. Amend RSA 6:12, I(b)(338) to read as follows:
(338) Moneys deposited in the uncompensated care and Medicaid fund established in RSA 167:64, I.
2 New Subparagraph; State Treasurer; Application of Receipts. Amend RSA 6:12, I(b) by inserting after subparagraph (394) the following new subparagraph:
(395) Moneys deposited in the disproportionate share hospital fund established in RSA 167:64, V.
3 New Paragraph; Uncompensated Care and Medicaid Fund; Disproportionate Share Hospital Fund Added. Amend RSA 167:64 by inserting after paragraph IV the following new paragraph:
V. There is hereby established in the department of health and human services the disproportionate share hospital fund, which shall be kept separate and distinct from all other funds. All disproportionate hospital share hospital revenue received by the department shall be credited to the fund. The moneys in the fund shall be nonlapsing and continually appropriated to the department for the purpose of redistributing disproportionate share hospital funds between and among hospitals for compliance with the federally required disproportionate share hospital examinations.
4 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill establishes a dedicated, nonlapsing fund devoted to receiving and expending funds related to the Disproportionate Share Hospital (DSH) program. The Department of Health and Human Services states that the federal Centers for Medicare and Medicaid Services (CMS) require that a DSH examination be completed each fiscal year to determine the proper amount of DSH owed to each hospital. Once this examination is completed, the Department collects DSH funds that were paid in excess of the amount to which a hospital was entitled. These excess payments, once collected, are redistributed to eligible hospitals in the manner outlined in the Medicaid State Plan Amendment. The fund established by this bill would be dedicated to executing these transactions. Accordingly, because all the funds that are received will be paid out to other hospitals, the bill will be cost neutral to the Department.
