STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT extending the time to petition for a new trial in certain cases.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Proceedings in Court; New Trials; Time. Amend RSA 526:4 to read as follows:
526:4 Time.
I. A new trial shall not be granted unless the petition is filed within three years after the rendition of the judgment complained of, or the failure of the suit, unless a longer time period is warranted in the interests of justice.
II. This time limit shall not apply to a motion for new trial that avers that newly discovered evidence, new or additional forensic testing, or new scientific understanding would have been a real factor for the factfinder.
2 Effective Date. This act shall take effect January 1, 2025.

METHODOLOGY:
This bill extends the time to petition a court for a new trial in certain cases.
The Judicial Branch states it is not possible to estimate how this change in law would impact the number of filings in the courts. Because the bill would expand the instances in which a new trial petition could be filed or granted, it is expected that litigation would increase, potentially significantly.
