Amendment to SB 527

 

Amend the title of the bill by replacing it with the following:

 

AN ACT relative to local planning and zoning regulations pertaining to student housing and occupancy.

 

Amend the bill by replacing all after section 1 with the following:

 

2 New Paragraph; Zoning; Authority; Occupancy.  Amend RSA 674:16 by inserting after paragraph V the following new paragraph:

VI.(a) In its exercise of the powers granted under this subdivision, the legislative body of a city, town, village, district, or county in which there are located unincorporated towns or unorganized places, shall not adopt nor shall the governing body thereof enforce any ordinance related to the occupancy of any existing or new single-family, duplex, or multi-family dwelling unit that:

(1)  Is based on the familial or non-familial relationships or marital status among the occupants of such property; or

(2)  Restricts the number of occupants of a single bedroom to less than 2.

(b)  Nothing in this paragraph shall prohibit the enforcement of the state building code or state fire code.

3 Effective Date.

I.  Section 1 of this act shall take effect July 1, 2025.

II.  The remainder of this act shall take effect 60 days after its passage.

AMENDED ANALYSIS

 

This bill includes the accommodation of student housing in the purpose of local zoning ordinances.  The bill also limits municipal discretion relative to occupancy ordinances.
