This bill provides that municipalities shall be responsible for reviewing criminal background checks of nominated health officers, with oversight of appointments by the department of health and human services.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT relative to background checks of municipal health officers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Town Health Officers; Background Check. Amend RSA 128:9 to read as follows:
128:9 Background Check. Each municipality shall request and obtain a criminal history record information request from the department of safety, as a prerequisite to any nomination of a health officer or deputy health officer, [to be submitted to the commissioner of the department of health and human services or his or her designee,] in order to determine if there are any prior convictions that may disqualify such person or interfere with the performance of his or her duties. Each municipality shall employ its discretion when reviewing background checks in accordance with its own established hiring practices. Appointments shall be subject to oversight of the commissioner of the department of health and human services, or the commissioner's designee.
2 Effective Date. This act shall take effect 60 days after its passage.
