STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT prohibiting the sale and use of adhesive-based rodent traps.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Adhesive-Based Rodent Traps. Amend RSA 339 by inserting after section 79 the following new subdivision:
Adhesive-Based Rodent Traps
339:80 Adhesive-Based Rodent Traps.
I. In this section:
(a) "Adhesive-based trap" means any device that is designed or is capable of being used to capture a rodent by means of an adhesive substance, including devices commonly known as glue traps, glue boards and any similar rodent trap.
(b) "Distributor” means any person who delivers to a person other than a purchaser, for the purpose of retail sale.
(c) "Exterminator" means a person or entity that is licensed, certified, permitted or otherwise authorized under the laws of this state to provide rodent and pest control services and any employee or agent thereof engaging in the provision of such services.
(d) "Manufacturer" means any person, firm, association, partnership, limited liability company, or corporation that produces, prepares, formulates, or compounds an adhesive-based trap as defined in this section. In the case of an adhesive-based trap imported into the United States, "manufacturer" means the importer or first domestic distributor of such product if the entity that manufactures the product or whose brand name is affixed to the product does not have a presence in the United States.
(e) "Retailer" means any person or entity who offers adhesive-based traps intended for the capture of rodents for sale, use, or consumption by persons in this state.
II(a) Adhesive-based traps intended for the capture of rodents shall not be shipped into this state. Such prohibition shall apply to all shipments into New Hampshire of adhesive-based traps intended for the capture of rodents, and includes importation or distribution for commercial purposes or personal use.
(b) No manufacturer, distributor, retailer, common carrier, or other person shall bring or carry into the state any adhesive-based trap intended for the capture of rodents, nor shall any manufacturer, distributor, retailer, common carrier, or any other person accept for delivery, deliver, or transport any adhesive-based trap intended for the capture of rodents to any distributor, retailer, or any other person.
(c) No manufacturer or distributor shall sell, offer for sale, or deliver to a retailer for subsequent sale an adhesive-based trap, nor shall any retailer or exterminator purchase, accept, obtain, or otherwise acquire any such adhesive-based trap.
III. No person, or any agent or employee thereof, shall sell or offer for sale, hold for sale, or distribute to another person any adhesive-based trap, as defined in this section, nor shall any person or agent or employee thereof purchase, acquire or possess any such adhesive-based trap for commercial or personal use.
IV Any person, distributor, exterminator, manufacturer, or retailer who violates this section shall be guilty of a separate violation for each day of sale or offering of sale, provided that the penalty for each violation of this section shall not exceed $500.
2 New Section; Adhesive-Based Rodent Traps. Amend RSA 430 by inserting after section 41 the following new section:
430:41-a Adhesive-Based Rodent Traps.
I. No person or any agent or employee thereof shall set, place, or otherwise use any such adhesive-based rodent trap, or permit another person to set, place or otherwise use any such adhesive-based trap to capture or destroy a rat, mouse, or other rodent, either indoors, outdoors, or in out-buildings.
II. A retailer having in its possession any adhesive-based traps intended for the extermination of rodents, purchased or acquired by such retailer prior to the effective date of this section, shall be authorized to sell such adhesive-based traps for 3 months after the effective date of this section.
III. An exterminator having in its possession any adhesive-based traps intended for the extermination of rodents, purchased or acquired prior to the effective date of this section, shall be authorized to set or place such adhesive-based traps while providing rodent control services for 3 months after the effective date of this section.
3 Pesticides Controls Administration and Enforcement. Amend RSA 430:42, V to read as follows:
V. The division may issue written "stop sale, use or removal" orders upon the owner or custodian of any pesticide or device, including adhesive-based traps intended for the extermination of rodents, when it is believed that such pesticide or device, including adhesive-based traps intended for the extermination of rodents, is being distributed in violation of any of the provisions of this subdivision, or of any of the prescribed rules under this subdivision. The pesticide or device, including adhesive-based traps intended for the extermination of rodents, shall not be sold, used or removed until the provisions of this subdivision have been complied with and the pesticide or device has been released by the division or the violation has been otherwise disposed of as provided in this subdivision by a court of competent jurisdiction.
4 Effective Date. This act shall take effect January 1, 2026.
