STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT prohibiting electric vehicles in commercial parking garages.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Electric Vehicle Garage Parking.  Amend RSA 265:69 by inserting after paragraph III the following new paragraph:

IV.  Park an electric vehicle in any commercial parking garage.  Any violation of this provision shall be reported to the police department upon discovery of the vehicle and shall result in a fine issued by the town, city or municipal police department having jurisdiction over the parking garage.  The amount of the fine shall be determined by each department, to be applied consistently for violations of this paragraph.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits electric vehicles from parking in parking garages and requires a fine to be issued by the town, city or municipal police department for any violation of this bill.

 

The New Hampshire Municipal Association (NHMA) states this bill bans electric vehicles from parking garages, requiring municipalities to enforce this ban.  However, due to the lack of data on the percentage of electric vehicles using municipal garages and the probability of nonelectric vehicles using these spaces, it's impossible to estimate the revenue impact accurately. It is anticipated that revenue would decrease, but the extent is indeterminable due to these limitations.  The decrease in revenue would potentially be offset by the increase in fines paid.

 

The NHMA also states, municipalities will need to consider if alternative parking for electric vehicles will be needed with the expected increase of electric vehicle numbers.  This may lead to the need for new parking spaces, either public or private, incurring expenses related to planning, zoning, construction, and land acquisition.  The exact cost is unknown, as it depends on individual municipal decisions.
