Floor Amendment to HB 2-FN-A-LOCAL
Amend the bill by inserting after section 463 the following and renumbering the original section 464 to read as 467:
464 Local Adoption of Public Health Ordinances. Amend RSA 147:1, I to read as follows:
I. The health officers of towns may make regulations for the prevention and removal of nuisances, [and such other regulations relating to public health] as in their judgment the health and safety of the people require, which shall take effect when approved by the selectmen, recorded by the town clerk, and published in some newspaper printed in the town, or when copies thereof have been posted in 2 or more public places in the town.
465 Communicable Disease; Immunization. Amend RSA 141-C:20-a, I to read as follows:
I. All parents or legal guardians shall have their children, who are residing in this state, immunized against [certain diseases. These diseases shall include, but not be limited to,] diphtheria, mumps, pertussis, poliomyelitis, rubella, rubeola, and tetanus. [The commissioner shall adopt rules under RSA 541-A relative to other diseases which require immunization.] The rules adopted by the commissioner requiring varicella, Hepatitis B, and Haemophilus influenzae type B (Hib) vaccinations shall remain in effect until their regular expiration date of June 30, 2026.
466 Repeal. RSA 141-C:6, XIII, relative to rulemaking for other communicable diseases under RSA 141-C:20-a, I.

AMENDED ANALYSIS
Add:
1. Changes when town public health officials may make regulations relating to public health.
2. Limits childhood immunization requirements to diseases identified in statute and removes the authority of the commissioner of health and human services to adopt rules requiring immunization for additional childhood diseases.
