Floor Amendment to HB 2-FN-A-LOCAL
Amend the bill by inserting after section 463 the following and renumbering the original section 464 to read as 472:
464 New Section; Firearms and Accessories; In-State Use Only. Amend RSA 159 by inserting after section 27 the following new section:
159:28 Firearms and Accessories Manufactured in New Hampshire for In-State Use Only.
I. Firearms and accessories manufactured within the state of New Hampshire, including but not limited to rifles, pistols, revolvers, shotguns, slides, receivers, barrels, suppressors, magazines, grips, and stocks, may be marked “For NH use only. Not for export outside NH.”
II. Such marked firearms and accessories shall not be exported or possessed outside the state and shall be ineligible for interstate commerce. It shall be a class B misdemeanor to export or transfer such a marked firearm or accessory outside the borders of the state.
III. It shall be a class B misdemeanor to alter, destroy, or remove the marking “For NH use only. Not for export outside NH” from marked firearms and accessories unless the firearm or accessory is rendered permanently inoperable.
IV. Firearms and accessories marked “For NH use only. Not for export outside NH,” while remaining within the state, shall be exempt from federal regulation of interstate commerce and any act of Congress reliant on authority delegated under the Commerce Clause of the United States Constitution.
465 Effective Date. Section 464 of this act shall take effect 60 days after its passage.
466 Carrying or Selling Weapons. RSA 159:16 is repealed and reenacted to read as follows:
159:16 Carrying or Selling Weapons.
I. Any person under the age of 18 who carries on his or her person any blackjack, slung shot, or metallic knuckles shall be guilty of a violation; and such weapon or articles so carried by such a person shall be forfeited to the state.
II. Any person who sells, delivers, or otherwise transfers any blackjack, slung shot, or metallic knuckles to a person under the age of 18 shall be guilty of a violation.
467 Repeal. RSA 159:17, relative to exceptions to the prohibition against carrying or selling weapons, is repealed.
468 Effective Date. Sections 466 and 467 of this act shall take effect January 1, 2026.
469 Child Protection Act; Reporting Law; Nature of Report; Liability. Amend RSA 169-C:30 and RSA 169-C:31 to read as follows:
169-C:30 Nature and Content of Report. An oral report shall be made immediately by telephone or otherwise, and followed within 48 hours by a report in writing, if so requested, to the department. Such report shall, if known, contain the name and address of the child suspected of being neglected or abused and the person responsible for the child's welfare, the specific information indicating neglect or the nature and extent of the child's injuries (including any evidence of previous injuries), the identity of the person or persons suspected of being responsible for such neglect or abuse, and any other information that might be helpful in establishing neglect or abuse or that may be required by the department. Reports made to the department may include the name, address, or phone number of the person or persons making the report of suspected abuse or neglect of a child under this chapter. The department may inform the complainant that should the complaint be made maliciously or with the intent to harm, the complainant may be subject to criminal and civil penalties.
169-C:31 Immunity From Liability.
I. Anyone participating in good faith in the making of a report pursuant to this chapter or who provides information or assistance, including medical evaluations or consultations, in connection with a report, investigation, or legal intervention pursuant to a good faith report of child abuse or neglect, is immune from any liability, civil or criminal, that might otherwise be incurred or imposed. Any such participant has the same immunity with respect to participation in any investigation by the department or judicial proceeding resulting from such report.
II. Nothing in this section shall provide civil or criminal immunity for a professional mandatory reporter who knowingly fails to make a report of suspected abuse or neglect under RSA 169-C:29 or for a person who knowingly files a false report of abuse or neglect with malice or the intent to harm under RSA 169-C:31-a.
470 New Sections; Child Abuse; Intentional False Report; Civil Liability. Amend RSA 169-C by inserting after section 31 the following new sections:
169-C:31-a Intentional False Report of Abuse or Neglect. No person shall maliciously or with the intent to harm make false statements of suspected child abuse or neglect as defined by RSA 169-C:3 to the department, to any court, to any law enforcement agency, to any social services agency, or to any professional mandatory reporter of suspected child abuse identified in RSA 169-C:29. Any person in violation of this section may be subject to civil and criminal liability under RSA 169-C:31-b and RSA 169-C:39, respectively.
169-C:31-b Civil Liability.
I. Any person harmed by the intentional submission of a false report of abuse or neglect under RSA 169-C:31-a may bring a civil action against the responsible party for monetary damages and other appropriate relief.
II. Any person who, in their professional capacity as a mandatory reporter under RSA 169-C:29, knowingly or intentionally fails to report suspected abuse or neglect may be subject to civil liability, including monetary damages, for the harm caused by the failure to report such abuse or neglect.
471 Effective Date. Sections 469 and 470 of this act shall take effect January 1, 2026.

AMENDED ANALYSIS
ADD:
190. Exempts firearms and firearm accessories manufactured for in-state use only from the National Firearm Act.
191. Amends the prohibition against carrying or selling a blackjack, slung shot, or metallic knuckles to prohibit sale to or possession of the said items by those under 18 years of age.
192. Provides that reports of suspected abuse and neglect may include the name of the person making the report and that a report made maliciously or with the intent to cause harm may be subject to civil and criminal penalties.
193. Provides that a person who in their professional capacity is a mandatory reporter of suspected abuse and neglect may be subject to civil liability for the failure to report.
