STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to the penalty for incorrect application of fertilizers.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Application of Fertilizer to Urban Turf and Lawn; Penalty.  Amend RSA 431:4-e by inserting after paragraph VII the following new paragraph:

VIII.  Notwithstanding RSA 431:18, any person and the corporate agent of such person, who violates this section:

(a)  Shall receive a written warning for a first offense;

(b)  Shall be guilty of a violation and shall be subject to a $250 fine per acre for a second offense; and

(c)  Shall be guilty of a misdemeanor for a third or subsequent offense.

2  Effective Date.  This act shall take effect upon its passage.
