Floor Amendment to HB 324-FN

 

Amend the bill by inserting after section 2 the following, and renumbering the original section 3 to read as 4:

 

3  New Paragraphs; Obscenity in Schools; Technical Assistance Advisory; Distribution.  Amend RSA 186:11 by inserting after paragraph XXXVII the following new paragraphs:

XXXVIII. In consultation with the attorney general's office, draft and distribute to school districts an annual technical assistance advisory for the purpose of providing guidance to school districts on the implementation and execution of RSA 189:79 and RSA 189:80. The advisory shall include information relevant to school districts’ obligations concerning the protection of students’ rights under the First Amendment to the United States Constitution. Such advisory shall further include detailed guidance on the application of the criteria under RSA 189:79, II, noting that all listed criteria in that paragraph shall be met in order to find that the material constitutes material harmful to minors.  

XXXIX.  Require that school districts annually verify that school board members and school principals in the district have received, read, and understand the technical assistance advisory required in paragraph XXXVIII of this section.

AMENDED ANALYSIS

 

This bill prohibits material that is obscene or harmful to minors in schools, creates a procedure for removal and cause of action, and requires that school districts draft a technical advisory detailing criteria of materials harmful to minors in schools and annually verify that school boards and principals understand students' First Amendment rights and the application of the statutory criteria.
