AMENDED ANALYSIS

 

This bill:

 

I.  Requires selectmen to obtain an approval vote to rent or lease a specified real property owned by the town for a period of more than one year and up to 99 years.

 

II.  Provides that selectmen can enter into leases of any real property owned by the town for up to one year without action by the legislative body, and that selectmen may be granted universal authority by an approval vote of the legislative body to enter into leases of any real property owned by the town for up to 5 years.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to the management and regulation of town real property.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

127:1 Choices and Duties of Town Officers; Selectmen; Town Property. Amend RSA 41:11-a, II and III to read as follows:

II. The authority under paragraph I shall include the power to rent or lease such property during periods not needed for public use, [provided, however, that any rental or lease agreement for a period of more than one year shall not be valid unless ratified by vote of the town.]subject to the following provisions:

(a) If the proposed lease is for one year or less, then the selectmen may lease the property without further action by the legislative body;

(b) If the proposed lease is for more than one year, then the legislative body shall vote to authorize the selectmen to enter into the proposed lease for a specific municipal property up to 99 years by majority vote. This vote to authorize a proposed lease of a specific municipal property, when the lease is for up to 5 years, is not required when the selectmen have been provided the universal lease authorization by the legislative body pursuant to paragraph III.

III. Notwithstanding paragraph II, the legislative body may vote to authorize the board of selectmen to rent or lease any municipal property for a term of up to 5 years without further vote or ratification of the town. Once adopted, this authority shall remain in effect until specifically rescinded by the legislative body at any duly warned meeting provided that the term of any lease entered into prior to the rescission shall remain in effect.

127:2 Applicability. RSA 41:11-a, II and III, as amended by section 1, shall not affect any leases in effect prior to the effective date of this act.

127:3 Effective Date. This act shall take effect 60 days after its passage.
