Amendment to HB 386-FN

 

Amend RSA 326-M:3, I(e) as inserted by section 2 of the bill by replacing it with the following:

 

(e)  Restrict the employment opportunities of nurses or licensed nursing assistants by including a non-compete clause or other restrictive covenant in excess of 13 weeks in any contract with an employee or health care facility nor fail to inform in writing the nurse or nursing assistant of said clause or covenant prior to offering an assignment.  A non-compete clause or other restrictive covenant shall not be in effect between an employee or health care facility and an agency for a nurse or nursing assistant who has not physically worked at the health care facility as part of their employment with the agency.
