ANALYSIS
This bill clarifies that the "practice of engineering" for purposes of the regulation of professional engineers does not include any professional service or creative work performed in the fields of information technology, information security, electronics, digital systems, or computing.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to the definition of professional engineer.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Professional Engineers; Definitions. Amend RSA 310-A:2, III to read as follows:
III. "Practice of engineering" means any professional service or creative work requiring education, training, experience, and the application of advanced knowledge of mathematics and physical sciences, involving the constant exercise of discretion and judgment, to such services or work as consultation, investigation, evaluation, planning, design, responsible oversight of construction, and responsible oversight of operation, in connection with any public or private utilities, structure, buildings, machines, equipment, processes, works, or projects, wherein the public welfare, or the safeguarding of life, health, or property is concerned. The "practice of engineering" does not include any professional service or creative work performed in the fields of information technology, information security, electronics, digital systems, or computing.
2 Effective Date. This act shall take effect 60 days after its passage.
