AN ACT relative to preventing municipal employees from being paid under multiple municipal contracts simultaneously.

This bill:

 

I. Prevents town managers, administrators, and school superintendents from being compensated by more than one town or district contract at a time.

 

II. Creates criminal penalties for town managers, administrators, and school superintendents who accept compensation from more than one town or district contract at a time.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to preventing municipal employees from being paid under multiple municipal contracts simultaneously.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Choice and Duties of Town Officers.  Amend RSA 41 by inserting after section 2-b the following new section:

41:2-bb  Rescission of Town Manager/Town Administrator Contracts

I.  No town manager or administrator shall be compensated for services as a town manager or administrator under two or more contracts at the same time.

II.  If a town manager or administrator is under contract with one town, and accepts a new contract with a different town, their primary contract shall be voided.

III.  Town managers and administrators shall be responsible for notifying town officials in the event they accept employment with a different town from which they are currently contracted to provide services.  Any person who fails to report acceptance of a new town manager or administrator employment offer while under contract as a town manager or administrator shall be guilty of a felony.

2  New Section; School Boards, Superintendents, Teachers, and Truant Officers; School Census.  Amend RSA 189 by inserting after section 33 the following new section:

189:33-a  Rescission of School Superintendent Contracts

I.  No school superintendent shall be compensated for services as a school superintendent under two or more contracts at the same time.

II.  If a superintendent is under contract with one town, and accepts a new contract with a different town, their primary contract shall be voided.

III.  School superintendents shall be responsible for notifying school officials in the event they accept employment with a different town from which they are currently contracted to provide services.  Any person who fails to report acceptance of a new superintendent employment offer while under contract as a superintendent shall be guilty of a felony.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits town managers, administrators, and school superintendents from receiving compensation from more than one town or district contract simultaneously.  Additionally, any person who fails to report the acceptance of a new contract in their role as a town manager, administrator, or school superintendent while still holding a current position in any of these capacities shall be guilty of a felony.

 

Additionally, this bill adds, deletes, or modifies a criminal penalty, or changes statute to which there is a penalty for violation. Therefore, this bill may have an impact on the judicial and correctional systems, which could affect prosecution, incarceration, probation, and parole costs, for the state, as well as county and local governments.
