Amendment to HB 587-FN

 

Amend the bill by replacing section 1 with the following:

 

1  New Subparagraph; Domestic Violence; One-Party Recording.  Amend RSA 570-A:2, II by inserting after subparagraph (m) the following new subparagraph:

(n)  Any person who is a party to a conversation, or who has the prior explicit consent of such a party, except a law enforcement officer acting in their official capacity, to make or possess a recording when that recording:

(1)  Is intended to be provided to a law enforcement agency or utilized for the purpose of court proceedings and is not publicly disclosed or released by the person or their agent; and

(2)  Is or contains evidence of what the person reasonably anticipates or believes to be a crime.
