Floor Amendment to HB 63

 

Amend the introductory paragraph of RSA 170-E:59, I as inserted by section 1 of the bill by replacing it with the following:

 

I.  The child has the written approval of the child's [physician] health care provider and the written approval of the parent or guardian.  The camp shall obtain the following information from the child's [physician]  health care provider:

 

Amend RSA 170-E:59, III-V as inserted by section 1 of the bill by replacing it with the following:

 

III.  The child's parent or guardian shall submit written verification from the [physician] health care provider confirming that the child has the knowledge and skills to safely possess and use [an] epinephrine [auto-injector] in a camp setting.

IV.  If the conditions provided in this section are satisfied, the child may possess and use the epinephrine [auto-injector] at the camp or at any camp-sponsored activity, event, or program.

V.  In this section, ["physician"] "health care provider" means any physician or health practitioner with the authority to write prescriptions.

 

Amend the introductory paragraph of RSA 200:42, I as inserted by section 2 of the bill by replacing it with the following:

 

I.  The pupil has the written approval of the pupil's [physician] health care provider and, if the pupil is a minor, the written approval of the parent or guardian.  The school shall obtain the following information from the pupil's [physician] health care provider:

AMENDED ANALYSIS

 

This bill:

 

I.  Allows authorized entities, including recreational camps, elementary schools, secondary schools, and institutions of higher education, to possess and administer epinephrine for the treatment of anaphylaxis.

 

II.  Removes the specific reference in current statutes to administration via auto-injectors.

 

III.  Changes references from "physician" to "health care provider" and clarifies that epinephrine prescribed for an individual at a school or camp may also be used to treat another individual experiencing an anaphylactic emergency.
