Floor Amendment to HB 677-FN

 

Amend the bill by replacing all after section 2 with the following:

 

3  Supply of Epinephrine Auto-Injectors/Epinephrine Nasal Spray; Reporting.  RSA 200:44-b, V is repealed and reenacted to read as follows:

V.  Schools shall submit an annual report to the department of education summarizing the supply and use of epinephrine auto-injectors and/or epinephrine nasal spray pursuant to this subdivision.

4  New Section; School Health Services; Epinephrine Fund.  Amend RSA 200 by inserting after section 44-b the following new section:

300:44-c  Epinephrine Fund.  There is hereby established in the state treasury the automated epinephrine fund.  The nonlapsing fund shall be kept separate and distinct from all other funds and shall be continually appropriated to the department of education for the purposes of this section.  The fund shall be used to provide financial support for the procurement and distribution of epinephrine auto-injectors and epinephrine nasal spray to schools in accordance with emergency plans for sports-related injuries under RSA 200:44-b.  The division may accept gifts, grants, donations, and other moneys for this purpose.

5  New Subparagraph; Application of Receipts; Dedicated Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (399) the following new subparagraph:

(400)  Moneys deposited in the epinephrine fund under RSA 200:44-c.

6  Effective Date.  This act shall take effect July 1, 2025.

AMENDED ANALYSIS

 

This bill:

 

I.  Requires public schools to maintain supplies of epinephrine auto-injectors and/or epinephrine nasal spray for use in the event of an allergic emergency and annual reporting summarizing such supply and use.

 

II.  Requires at least one assistive personnel to be available all hours of the school day.

 

III.  Provides an appropriation to the department of education for reimbursement of such supplies.

 

IV.  Establishes an automated epinephrine fund to provide financial support for the procurement and distribution of epinephrine auto-injectors and epinephrine nasal spray to schools.
