Floor Amendment to HB 71-FN
Amend the title of the bill by replacing it with the following:
AN ACT prohibiting the school facilities to be used to provide shelter for aliens, relative to department of health and human services contracts, and relative to construction of a public pier on Hampton Beach and making an appropriation therefor.
Amend the bill by replacing all after section 2 with the following:
3 New Section; Hampton Beach State Park Pier Fund. Amend RSA 216-J by inserting after section 5 the following new section:
216-J:6 Hampton Beach State Park Pier Fund. There is hereby established in the state treasury a fund to be known as the Hampton Beach State Park pier fund, which shall be kept separate and distinct from all other funds. The fund shall be continually appropriated to the department of natural and cultural resources, division of parks and recreation, for the purpose of obtaining engineering services, siting, permitting, final design, construction, and ongoing maintenance of an accessible pier at Hampton Beach State Park. The division shall take into consideration the recommendations and findings in the October 28, 2022, Hampton Beach New Pier Feasibility Study, conducted by the Hampton Area Chamber of Commerce and the department of natural and cultural resources, and the needs of persons with disabilities when designing and constructing the pier. The division may accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund. On July 1, 2035, the balance of fund shall be transfered to the state park gifts and donations account established under RSA 216-A:3-o, and used by the division for the purpose of expanding access to state parks for the disabled.
4 New Subparagraph; State Treasurer; Application of Receipts; Hampton Beach State Park Pier Fund. Amend RSA 6:12, II(b) by inserting after subparagraph 399 the following new subparagraph:
(400) Moneys deposited in the Hampton Beach State Park pier fund as established in RSA 216-J:6.
5 Division of Parks and Recreation; Hampton Beach State Park Pier; Appropriation. The sum of $1 for the biennium ending June 30, 2027, is hereby appropriated to division of parks and recreation for deposit in the Hampton Beach State Park pier fund, established in RSA 216-J:6, for the purposes of constructing an accessible public pier at Hampton Beach. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
6 Applicability. Section 2 of this act shall apply to contracts or contract amendments entered into on or after the effective date of that section.
7 Repeal. Section 2 of this act, relative to department of health and human services contracts, is repealed.
I. Section 7 of this act shall take effect November 30, 2026.
II. Sections 3-5 of this act shall take effect July 1, 2025.
III. The remainder of this act shall take effect 60 days after its passage.

AMENDED ANALYSIS
This bill:
I. Prohibits the use of public schools or institutions of higher learning from providing shelter for specified aliens who have not been admitted to the United States, absent a specified disaster.
II. Requires the department of health and human services to include references to the patients' bill of rights in contracts and contract addenda.
III. Establishes and makes an appropriation to the Hampton Beach State Park pier fund, a dedicated fund to be administered by the division of parks and recreation for the purpose of siting, permitting, designing, and constructing a public pier at Hampton Beach.
