STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to supportive housing options for individuals with developmental disabilities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Residential Care and Health Facility Licensing; License or Registration Required; Exemption for Supportive Housing Options for Individuals with Developmental Disabilities. Amend RSA 151:2, II(a) to read as follows:
(a) [Facilities] Dwelling units which are operated for the continuing care of one person or 3 or fewer persons in a facility certified by the commissioner of health and human services under RSA 126-A:19 and RSA 126-A:20, without regard to how many such units may be sited in a given structure and without regard to the existence, or lack of, areas of common use in such a structure. For purposes of this subparagraph, "dwelling unit" means a single leasable unit providing complete and independent living facilities for one or more persons including permanent appliances and fixtures for living, sleeping, eating, cooking, and sanitation. Such units shall meet certification standards established by the commissioner of health and human services under RSA 126-A:19 and RSA 126-A:20.
2 Effective Date. This act shall take effect 60 days after its passage.
