AMENDED ANALYSIS

 

This bill further specifies requirements for emergency plans for sports related injuries and appropriates $1 to the division of fire standards and training and emergency medical services to aid in funding and distributing AEDs to schools, in order that they may comply with requirements for AEDs according to emergency plans for sports related injuries.  The bill also establishes a dedicated fund administered by the division of fire standards and training and emergency medical services to assist schools in procuring AEDs.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to school emergency plans for sports related injuries.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Emergency Plans for Sports Related Injuries; Requirements.  Amend RSA 200:40-c to read as follows:

200:40-c Emergency Plans for Sports Related Injuries.

I. The local board of each school district or the governing body of each nonpublic school that includes any of the grades 4 through 12, shall establish an emergency action plan for responding to serious or potentially life-threatening sports related injuries. Each plan shall:

(a) Document the proper procedures to be followed when a student sustains a serious injury or illness while participating in school sponsored sports or other athletic activity.

(b) List the employees, team coaches, and licensed athletic trainers in each school who are trained in first aid or cardiopulmonary resuscitation that follow evidence-based guidelines set forth by the American Heart Association or other nationally recognized organization or association focused emergency cardiovascular care.

(c) Identify the employees, team coaches, or licensed athletic trainers responsible for carrying out the emergency action plan.

(d) Identify the activity location, address, or venue for the purpose of directing emergency personnel.

(e) Identify the equipment and supplies and location thereof needed to respond to the emergency.

(f) Identify the location of any automated external defibrillators and personnel trained in cardiopulmonary resuscitation (CPR) and the use of the automated external defibrillator (AED). If the school has AEDs:

(1) The school will regularly check and maintain the AED according to the manufacturer's instructions; and

(2) At least one AED shall be readily accessible in a well-marked and safe place to each athletic event or venue where practices and competitions are held for use in responding to cardiac emergencies and shall not be locked in an office or be stored in a location that is not easily and quickly accessible.

(3) AEDs shall be readily accessible, in accordance with guidelines set by the American Heart Association or other nationally recognized guidelines focused on emergency cardiovascular care, to each athletic venue where practices and competitions are held, in which pupils of the school are participating.

(g) Document policies related to cooling for an exertional heat stroke victim consistent with guidelines established by the American College of Sports Medicine and the National Athletic Trainers' Association.

(h) Require that for grades 6-12 an individual trained in cardiopulmonary resuscitation supervise organized school sponsored sports activities in which pupils of the school are participating.

2  New Section; School Health Services; AED Fund.  Amend RSA 200 by inserting after section 40-c the following new section:

200:40-d  AED Fund.  There is hereby established in the state treasury the automated external defibrillator (AED) fund.  The nonlapsing fund shall be kept separate and distinct from all other funds and shall be continually appropriated to the department of safety, division of fire and standards and training and emergency medical services for the purposes of this section.  The fund shall be used to provide financial support for the procurement and distribution of AEDs to schools in accordance with emergency plans for sports related injuries under RSA 200:40-c.  The division may accept gifts, grants, donations, and other moneys for this purpose.

3  New Subparagraph; Application of Receipts; Dedicated Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (399) the following new subparagraph:

(400)  Moneys deposited in the AED fund under RSA 200:40-d.

4  Appropriation; Department of Safety; Division of Fire Standards and Training and Emergency Medical Services; Automated External Defibrillator.  

I.  There is hereby appropriated from the general fund to the division of fire standards and training and emergency medical services the sum of $1 for the fiscal year ending June 30, 2026 for the purpose of creating funds for which public and non-public schools may apply in order to implement cardiac emergency response preparedness plans for school athletic events and practices.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

II.  Funding shall be used for activities and equipment that promote cardiac emergency response preparedness for school athletic practices and events, including but not limited to the purchase of AEDs which meet the standards established by the United States Food and Drug administration, and AED maintenance (pads and battery replacement), the purchase of CPR training kits or CPR/AED training for faculty and staff, basic first aid training, and educational materials.

III.  Funding priority shall be given to Title I schools, schools in high need school districts according to NCLB Title II-D guidelines, or other schools where at least 50 percent of students are eligible for free and reduced-price school meals.

IV.  To receive funding, schools shall provide a copy of their written emergency action plan for school sports in a manner determined by the bureau of emergency medical services.

5  Effective Date.  This act shall take effect July 1, 2025.

METHODOLOGY:

This bill increases requirements set forth for school districts relative to cardiovascular care and automated external defibrillators (AEDs) and appropriates $80,000 in each FY 2026 and FY 2027 from the general fund to the Department of Safety for reimbursement to districts for associated costs to comply.  The Department has not identified any costs associated with administering the reimbursement requests and disbursements. It is assumed $80,000 would be disbursed in each year, however, it is unknown if this would be sufficient to cover what the total costs would be for school districts to comply, as they would vary from district to district.  This bill also establishes a new dedicated fund.

 

This bill provides priority for Title I schools, schools in high need school districts according to NCLB Title II-D guidelines, or other schools where at least 50% of students are eligible for free and reduced-priced school meals. Ultimately, this bill’s impact on local school district expenditures is indeterminable, as it is unknown what districts currently have in place and any costs would vary from district to district. For informational purposes, the Department of Education has provided the following:

 

  • Total number of public and nonpublic schools = 631
  • Total number of district public schools = 467
  • Average cost of a single AED = $2,500
  • Estimated Cost of Required AED and CPR Training Per Person Per Year = $150
