STATE OF NEW HAMPSHIRE

AN ACT increasing the minimum age for sports betting.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Sports Betting; Definitions.  Amend RSA 287-I:1, II to read as follows:

II. "Authorized sports bettor" means an individual [18] 21 years of age or older who is physically present in the state of New Hampshire when placing a sports wager with the commission or an authorized agent of the commission and is not a prohibited sports bettor.

2  Mobile Sports Wagering Authorized.  Amend RSA 287-I:7, I to read as follows:

I. Age verification measures to be undertaken to block access to and prevent sports wagers by persons under the age of [18] 21 years.

3  Effective Date.  This act shall take effect January 1, 2026.

METHODOLOGY:

This bill, effective January 1, 2026, increases the minimum age for placing a sport wager from 18 to 21. In FY 2024, state revenue from sports betting was $33,654,911, of which approximately 1.9% of gross gaming revenue came from individuals under the age of 21. Therefore, the revenue attributable to bettors aged 18 to 20 in FY 2024 would be $639,443. Sports betting revenue can shift based on a variety of factors, however, the Lottery Commission expects this number to remain consistent for FY 2026 and beyond. Considering this bill is effective halfway through FY 2026, it is expected to decrease state lottery revenue, and transfer to the education trust fund, by approximately $320,000 in FY 2026 and by $640,000 in FY 2027 and each year thereafter.
