Floor Amendment to SB 14-FN
Amend the title of the bill by replacing it with the following:
AN ACT relative to the penalty for certain fentanyl-related offenses; relative to establishing a mandatory minimum sentence for the crime of distribution of a controlled drug with death resulting; relative to amending the penalties for the possession and use of a quantity of psilocybin for persons 18 years of age or older; and relative to cultivation locations for alternative treatment centers.
Amend the bill by replacing all after section 4 with the following:
5 New Paragraph; Use of Cannabis for Therapeutic Purposes; Alternative Treatment Centers; Cultivation Location. Amend RSA 126-X:7 by inserting after paragraph X the following new paragraph:
XI. The department may authorize each operator of an alternative treatment center registered under RSA 126-X:7 to operate an additional cultivation location, which shall be a greenhouse, and which shall be subject to rules adopted by the department under RSA 126-X:6, III, and all applicable provisions of this chapter, including, but not limited to, compliance with local zoning laws. The department shall, in conjunction with the local governing body of the town or city where the additional cultivation location would be located, solicit input from qualifying patients, designated caregivers, and residents of the town or city in which the additional cultivation location would be located.
I. Sections 1-4 of this act shall take effect January 1, 2026.
II. The remainder of this act shall take effect 60 days after its passage.

AMENDED ANALYSIS
This bill:
I. Adds mandatory minimum sentences for certain fentanyl-related offenses.
II. Sets a mandatory minimum sentence for the crime of distribution of a controlled drug with death resulting.
III. Modifies the penalties for a person 18 years of age or older to obtain, purchase, transport, possess, or use a certain quantity of psilocybin.
IV. Allows additional cultivation centers to be considered for alternative treatment centers.
