AMENDED ANALYSIS

I. Allows hotels and motels to deny or refuse rental agreements with guests under the age of 21.
II. Repeals the requirement that hotel keepers post a notice of rental rates in hotel rooms.
III. Repeals the requirement that motel operators place signs displaying rates for rental units.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to hotel and motel operations.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Trade and Commerce; Hotels, Tourist Cabins, Etc.; Registered Departure Date. Amend RSA 353:3-b to read as follows:
353:3-b Registered Departure Date. All hotel keepers and all persons keeping public lodging houses, tourist camps, or cabins shall, upon the registration of each guest, [cause an entry to be made in the book or card system required by RSA 353:3 which shall] record the guest's agreed upon departure time and date. No guest shall, without the consent of the hotel keeper or such person keeping a public lodging house, tourist camp, or cabin remain in a rental unit beyond the departure time and date so recorded at registration.
2 New Section; Trade and Commerce; Public Accommodations; Rental Agreement Policies With Guests Under 21. Amend RSA 354-A by inserting after section 17 the following new section:
354-A:17-a Rental Agreement Policies With Guests Under 21. Nothing in this subdivision shall prohibit a hotel, motel, or other lodging establishment held out to transient guests for public accommodations from having policies denying or refusing rental agreements with guests under 21 years of age.
3 Repeal. The following are repealed:
I. RSA 353:3-a, relative to posting of rental rates.
II. RSA 353:5, relative to motel signs.
4 Effective Date. This act shall take effect upon its passage.
