Floor Amendment to SB 241-FN-A

 

Amend the bill by replacing all after the enacting clause with the following:

 

1  New Section; Hampton Beach State Park Accessibility Fund.  Amend RSA 216-J by inserting after section 5 the following new section:

216-J:6  Hampton Beach State Park Accessibility Fund.  

I.  There is hereby established in the state treasury a fund to be known as the Hampton Beach state park accessibility fund, which shall be kept separate and distinct from all other funds.  The fund shall be continually appropriated to the department of natural and cultural resources, division of parks and recreation, for the purpose of obtaining engineering services, siting, permitting, final design, construction, and ongoing maintenance to improve accessibility for people with disabilities to Hampton Beach State Park, including, but not limited to, the construction of an accessible walking pier.  The division, in consultation with the governor’s commission on disability, shall take into consideration the recommendations and findings of the October 31, 2024, Hampton Beach State Park accessibility feasibility study, conducted by the department of natural and cultural resources, while factoring in impacts to the wildlife and environment.

II.  The division may accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund.  On July 1, 2035, the balance of funds shall be transferred to the state park gifts and donations account established under RSA 216-A:3-o, and used by the division for the purpose of expanding access to state parks for the disabled.

2  New Subparagraph; State Treasurer; Application of Receipts; Hampton Beach State Park Accessibility Fund.  Amend RSA 6:12, II(b) by inserting after subparagraph 399 the following new subparagraph:

(400)  Moneys deposited in the Hampton Beach State Park accessibility fund as established in RSA 216-J:6.

3  Division of Parks and Recreation; Hampton Beach State Park Accessibility; Appropriation.  The sum of $1 for the biennium ending June 30, 2027, is hereby appropriated to division of parks and recreation for deposit in the Hampton Beach State Park accessibility fund, established in RSA 216-J:6, for the purposes of improving accessibility for people with disabilities to Hampton Beach State Park.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

4  Effective Date.  This act shall take effect July 1, 2025.

AMENDED ANALYSIS

 

This bill establishes and makes an appropriation to the Hampton Beach State Park pier fund, a dedicated fund to be administered by the division of parks and recreation for improving accessibility for people with disabilities to Hampton Beach State Park.
