ANALYSIS
This bill authorizes towns to create revolving funds for installation and maintenence of electric vehicle charging stations. This bill prohibits any person not driving an emergency vehicle from stopping, standing, or parking in a parking place designated for electric vehicles.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to electric-vehicle charging station funding.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Miscellaneous; Revolving Funds. Amend RSA 31:95-h, I by inserting after subparagraph (g) the following new subparagraph:
(h) Installing and maintaining an electric vehicle charging station.
2 Stopping, Standing, or Parking Prohibited in Specified Places. Amend RSA 265:69, I(j) through (m) to read as follows:
(j) In any parking place, whether on public or private property, specially designated for a person with a walking disability by means of a sign as required by RSA 265:73-a stating that the space is reserved for a person with a walking disability or displaying the international accessibility symbol, unless that person has a special plate or placard issued or recognized pursuant to RSA 261:86 or RSA 261:88, and the person who qualifies for the plate or placard is being transported to or from the parking place. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $250 of which 20 percent is payable to the town or city where the violation occurred;
(k) In any parking place, whether on public or private property, specially designated for an electric vehicle by means of a sign affixed to a post or a building, clearly visible to anyone directly approaching that particular parking place, meeting the Manual on Uniform Traffic Control Devices for Streets and Highways?(MUTCD) requirements to show that the space is reserved for electric vehicle charging, unless the vehicle is being actively charged. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $62 of which 20 percent is payable to the town or city where the violation occurred;
[(k)](l) On any controlled access highway;
[(l)] (m) In the area between roadways of a divided highway, including crossovers;
[(m)](n) In or overlapping into any access aisle. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $50 for a first offense and a minimum of $100 for each subsequent offense.
3 Stopping, Standing or Parking; Enforcement of Parking Prohibition in Parking Spaces and Access Aisles Designated for Persons With a Walking Disability. Amend RSA 265:69-a, I to read as follows:
I. Testimony under oath with clear photographic evidence from a person with a walking disability pursuant to RSA 261:86 or RSA 261:88 or the driver of a vehicle transporting such a person that a vehicle that does not display a special plate or placard issued or recognized pursuant to RSA 261:86 or RSA 261:88 was parked in a designated parking space for persons with a walking disability or any vehicle parked in or overlapping into an access aisle shall be sufficient evidence to prove that the owner of the vehicle has violated RSA 265:69, I(j) or [(m)] (n), unless such evidence is rebutted or contradicted.
4 Effective Date. This act shall take effect 60 days after its passage.

FISCAL IMPACT:
The Legislative Budget Assistant has determined that this legislation has a total fiscal impact of less than $10,000 in each of the fiscal years 2025 through 2028.
