Floor Amendment to SB 62

 

Amend the bill by replacing section 1 with the following:

 

1  New Chapter; Participation in Federal Immigration Programs.  Amend RSA by inserting after chapter 106-O the following new chapter:

CHAPTER 106-P

PARTICIPATION IN FEDERAL IMMIGRATION PROGRAMS

106-P:1  Participation in Federal Immigration Programs.

Neither the state nor any county, municipality, or other political subdivision of this state shall prohibit or impede any state, county, or local law enforcement agency from applying for entry or entering into an agreement with the United States Immigration and Customs Enforcement to participate in a federal 287(g) program pursuant to 8 U.S.C. section 1357(g).

106-P:2  Identification of Officers Participating in Federal Immigration Programs.  For any state, county, or local law enforcement agency that participates in a federal 287(g) program, the state, county or local law enforcement officer shall, when taking any action pursuant to the authority granted by the program, identify themselves by name, badge number, and agency and shall state that they are operating under the authority of United States Immigration and Customs Enforcement.
