STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT allowing for appointment by county attorneys of investigators with law enforcement powers.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; County Attorneys; Appointment of Investigators.  Amend RSA 7 by inserting after section 33-g the following new section:

7:33-h  Appointment of Investigators with Law Enforcement Authority.

I.  Subject to available county appropriations, and with the approval of the county commissioners, a county attorney may appoint investigators within the county attorney's office to which he or she is elected, each of whom shall have statewide law enforcement authority and shall be a peace officer as defined by RSA 594:1, III.  Any person appointed to such a position shall be certified or eligible for certification as a police officer pursuant to RSA 106-L:5, V.  An investigator appointed under this paragraph shall be removed if he or she fails to achieve certification or if he or she is decertified by the police standards and training council.

II.  Each appointee under paragraph I shall report to the county attorney.  Operational control over such investigators shall rest solely with the county attorney.

III.  Nothing in this section shall preclude county attorneys from appointing investigators who are not certified law enforcement officers and do not have the powers and authority of a law enforcement officer.

2  Effective Date.  This act shall take effect 60 days after its passage.
