Amendment to HB 1046-FN
Amend the bill by replacing all after the enacting clause with the following:
1 Loaded Firearms; OHRV; Snowmobile. Amend RSA 207:7, II to read as follows:
II. No person shall have or carry, in or on a motor vehicle, OHRV, snowmobile, or aircraft, when moving, a cocked crossbow, a loaded rifle or loaded shotgun, muzzleloader, or air rifle, except a person or a person's agent while in the act of protecting his or her interest in their livestock or crops. Except when crossing or traveling on a public way, such person or the person's agent may carry a loaded rifle or shotgun, muzzleloader, or air rifle while traveling through or between farming or agricultural areas while in the course of protecting his or her interest in their livestock or crops. Nothing in this paragraph shall be construed to prohibit the carriage of a firearm on a snowmobile or OHRV when such carriage is not prohibited by RSA 215-C:35 or RSA 215-A:20.
2 Loaded Firearms; Snowmobiles. Amend RSA 215-C:35 to read as follows:
215-C:35 Loaded Firearms Forbidden. No person shall carry on a snowmobile, or a trailer towed by same, any firearms unless said firearm is unloaded. This section shall not apply to law enforcement officers carrying firearms in the course of duty or to pistols or revolvers carried by any person who is not prohibited from possessing a firearm by a New Hampshire statute. This section shall not apply when the snowmobile is being operated on private property where the operator has the express or implied permission or license of the landowner or lawful occupant to be present, provided that such permission does not arise solely by way of a public right-of-way, public trail, or designated snowmobile corridor. For the purposes of this section, "unloaded" shall mean that the firearm is not loaded as defined in RSA 207:1, XIV-a.
3 Effective Date. This act shall take effect January 1, 2027.
