Amendment to HB 1086-FN
Amend the title of the bill by replacing it with the following:
AN ACT creating a committee to study neonicotinoid seed treatments.
Amend the bill by replacing all after the enacting clause with the following:
1 Committee Established. There is established a committee to study neonicotinoid seed treatments.
2 Membership and Compensation.
I. The members of the committee shall be as follows:
(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(b) One members of the senate, appointed by the president of the senate.
II. Legislative members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.
3 Duties. The committee shall study:
I. Data from Quebec on the results of that province’s ban on neonicotinoid treated seeds, including a breakdown of affected crop types and acreage of each, changes in crop yields using non-treated and alternatively treated seed, availability and cost of seed alternatives in preferred hybrids and with alternative coatings, observed environmental changes with the use of alternative coatings, changes in pesticide application practices, interactions of cover cropping practices, pest load, and seed coating use, and use of the waiver process.
II. Data from Cornell College of Agriculture and Life Sciences on the use and effects of neonicotinoid treated seeds and observed changes to yields and agricultural practices, including cover cropping and pesticide use, when neonicotinoid seed treatments are discontinued.
III. The steps being taken by New York and Vermont to insure that farmers will have seed available in preferred hybrids and preferred alternative treatments.
IV. The steps seed dealers producers and dealers are taking to meet the needs of markets in New York, Vermont, and Quebec.
4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 90 days of the effective date of this section. Three members of the committee shall constitute a quorum.
5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2026.
6 Effective Date. This act shall take effect upon its passage.
