ANALYSIS
This bill prohibits the sale or use of corn, wheat, or soybean seeds if such seeds have been treated with neonictinoids and allows a seller to request a waiver from the commissioner of the department of agriculture, markets, and food in writing.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT prohibiting the sale of certain agricultural seeds treated with neonicotinoids.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Neonicotinoid Prohibited. Amend RSA 433:4 by inserting after paragraph II the following new paragraph:
III. To sell, offer for sale, expose for sale, import into this state, or use any corn, wheat, or soybean seeds which have been treated by a neonicotinoid seed treatment. A person may receive a waiver to sell, offer for sale, expose for sale, import into this state, or use any corn, wheat, or soybean seed treated by a neonicotinoid seed treatment by requesting one in writing from the commissioner of the department of agriculture, markets, and food.
2 Effective Date. This act shall take effect January 1, 2029.
