Floor Amendment to HB 1132
Amend the title of the bill by replacing it with the following:
AN ACT prohibiting the display of certain flags and banners in public schools and public charter schools.
Amend the bill by replacing all after the enacting clause with the following:
1 New Section; Display of Flags and Banners Prohibited. Amend RSA 189 by inserting after section 17-b the following new section:
189:17-c Display of Flags and Banners Prohibited.
I. All public schools and public charter schools shall be prohibited from displaying any flag or banner inside or outside of school buildings other than the flag of the United States of America, the New Hampshire state flag, and the POW/MIA flag, notwithstanding paragraphs II and III of this section.
II. Flags and banners exempt from this section shall include:
(a) Flags and banners used for instruction in foreign languages, world geography, math, language arts, and United States history classes.
(b) Flags and banners officially representing the school, including those used at school sponsored sports and events.
(c) Flags representing a branch of the United States military.
(d) National flags of the home countries of foreign exchange students actively attending the school.
(e) The national flag of Canada at any recreational facility used as a hockey rink or basketball court where such facility is owned by the public school district or public charter school.
(f) Official state flags of any other state where students actively attending the school are domiciled, including, but not limited to, where a public school district or public charter school accepts tuition from a student domiciled outside of New Hampshire.
(g) An official city or town flag of a city or town located in the state of New Hampshire.
(h) Any other flag or banner approved by the public school board or public charter school board of trustees.
III. All schools located in interstate school districts shall display inside or outside of school buildings the official state flags of the other states that are within such interstate school district.
2 Effective Date. This act shall take effect September 1, 2026.

AMENDED ANALYSIS
This bill prohibits the display of certain flags and banners in public schools and public charter schools, with certain exceptions. This bill also requires the display of official state flags of other states in interstate school districts.
