ANALYSIS

 

This bill prohibits motor vehicle manufacturers, dealers, and their agents from offering or requiring subscription fees for the activation or use of certain motor vehicle features that are already installed at the time of sale or lease.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to subscription fees for motor vehicle features.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraphs; Vehicle Feature Prohibited.  Amend RSA 357-C:3 by inserting after paragraph IV the following new paragraphs:  

IV-a.  No manufacturer, motor vehicle dealer, or agent thereof shall offer or require a subscription service for the use or activation of any motor vehicle feature that:  

(a)  Utilizes components, software, or hardware already installed, enabled, or activated on the vehicle at the time of purchase or lease by the consumer;

(b)  Would function after activation without ongoing cost to the dealer, manufacturer, or any third-party service provider; and

(c)  Would function as an advanced safety feature through software-dependent driver assistance.  

IV-b.  Paragraph IV-a shall not apply to:  

(a)  Dealer-supported navigation system updates, live traffic data, live agent navigation assistance, integrated streaming services, third-party satellite radio, in-vehicle Wi-Fi, roadside assistance, software-dependent driver assistance or driver automation features, or vehicle-connected services that require cellular, wireless, or data networks for ongoing operation; or

(b)  Any software update provided by the dealer or manufacturer if no fee is charged for any update that remedies a safety-related defect required under federal or state law.  

2  Effective Date.  This act shall take effect 60 days after its passage.
