STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT requiring health care providers to disclose medical services billed to the patient's insurance carrier.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Medical Records, Patient Information, and The Health Information Organization Corporation; Disclosure of Medical Services Billed to Insurance Carrier.  Amend RSA 332-I by inserting after section 13 the following new subdivision:

Disclosure of Medical Services Billed to Insurance Carrier

332-I:14  Definitions.  In this subdivision:

I.  “Health care provider” means any individual or entity licensed or certified to provide health care services, including but not limited to hospitals, clinics, physicians, and other medical professionals.

II.  “Patient” means an individual who receives medical services from a health care provider.

III.  “Insurance carrier” means any entity that provides health insurance coverage, including private insurers and government programs.

IV.  “Medical services” means any diagnostic, therapeutic, surgical, or other health-related services provided to a patient.

332-I:15  Disclosure Requirement.

I.  A health care provider shall furnish to each patient, or the patient’s authorized representative, a written or electronic statement listing all medical services billed to the patient’s insurance carrier.

II.  The statement shall include:

(1)  A description of each service provided;

(2)  The date the service was rendered;

(3)  The billing code or codes used;

(4)  The amount billed to the insurance carrier;

(5)  The amount paid or denied by the insurance carrier; and

(6)  Any remaining balance for which the patient may be responsible.

(c)  The statement shall be provided within 15 business days of submission of the claim to the insurance carrier.

332-I:16  Method of Disclosure.

I.  The disclosure may be provided electronically via secure patient portals, email, with patient consent, or in hard copy upon request.

II.  Health care providers shall ensure that the information is presented in a clear and understandable format.

2  Effective Date.  This act shall take effect 60 days after its passage.
