1 New Hampshire Telemedicine Act; Coverage for Telemedicine Services. Amend RSA 415-J:3, III to read as follows:
III. An insurer offering a health plan in this state shall provide coverage and reimbursement for health care services provided through telemedicine on the same basis as the insurer provides coverage and reimbursement for health care services provided in person.
2 New Section; Coverage for Telemedicine Services; Penalties. Amend RSA 415-J by inserting after section 3 the following new section:
415-J:4 Penalties; Private Right of Action.
I. Any insurer violating any of the provisions of RSA 415-J:3 may be subjected to an administrative fine not to exceed $2,500 per violation. The commissioner also may suspend or revoke the certificate of authority or license of an insurer found to have violated any of the provisions of RSA 415-J:3.
II. If an insurer is found to have violated any of the provisions of this chapter 3 or more times within a 5-year period, any person aggrieved may initiated an action against such insurer and may recover court costs and reasonable attorney's fees as the prevailing party, provided however, that nothing in this section shall supercede or replace existing rights or remedies under any other law.
3 Effective Date. This act shall take effect January 1, 2027.

Any telemedicine code that is substantively equivalent to an in-person code from the standpoint of personally delivered services by a provider shall be reimbursed by an insurer at an identical level to the equivalent in-person code.
