This bill requires executive branch agencies to base all contracting and investment decisions on providing direct benefits, services, or goods to New Hampshire citizens, with certain requirements and guidelines.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to contracting and investment decisions by executive branch agencies.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Statement of Purpose. It is the policy of the state of New Hampshire that decisions concerning contracting and investing by executive branch agencies shall be made solely in the interest of, and for the exclusive purpose of providing benefits, services, and goods to, the citizens of New Hampshire.

2  New Section; Limitation of Purpose of Contracting and Investing Decisions.  Amend RSA 21-I by inserting after section 11-e the following new section:

21-I:11-f Limitation on Purpose of Contracting and Investing Decisions.

I. All contracting and investing actions by any executive branch agency, including departments, boards, commissions, and institutions as defined in RSA 21-I:11, shall be undertaken solely in the interest of, and for the exclusive purpose of providing benefits, services, and goods to the citizens of New Hampshire.

II. No executive branch agency shall award or renew any contract, or make any investment or other expenditure, unless the primary and exclusive purpose of such action is to provide a direct benefit, service, or good to the citizens of New Hampshire. Agencies shall not consider, nor be required to further, interests, policies, or objectives extraneous to or inconsistent with this purpose.

III. This section shall not preclude compliance with the express requirements of federal law, or valid conditions for receipt of federal funds, nor shall it prohibit actions to the extent required for participation in multistate or federal programs that confer a direct benefit, service, or good to New Hampshire citizens.

IV. All contracts entered into by executive branch agencies shall contain a certification by the agency that the contract is consistent with the requirements of this section. The director of procurement and support services shall develop and provide a standard certification for this purpose, and may issue such additional rules and guidance as are necessary to administer this section.

V. If a part of this act is invalid, all valid parts that are severable from the invalid part remain in effect.  If a part of this act is invalid in one or more of its applications, the part remains in effect in all valid applications that are severable from the invalid applications.

VI. For purposes of this section, “agency,” “contract,” and “purchase” shall have the same meaning as provided in RSA 21-I:11, II.

3  Effective Date.  This act shall take effect 60 days after its passage.
