Amendment to HB 1258
Amend RSA 485-A:4, XIX as inserted by section 1 of the bill by replacing it with the following:
XIX.(a) To publish on its public website the results of all PFAS sampling and testing conducted, received, or compiled by the department, including but not limited to:
(1) Public water systems;
(2) Private wells tested under state-funded or state-contracted programs;
(3) Surface water, groundwater, soil, and sediment sampling conducted or overseen by the department;
(4) Biosolids, sludge, septage, compost, or other residuals tested or overseen by the department, including land application sites;
(5) Environmental biomonitoring, including fish tissue or other wildlife studies, conducted or overseen by the department; and
(6) Air emissions.
(b) To publish results, to the extent practicable and using existing departmental data systems or reporting platforms, in a format searchable by location, date, and PFAS contaminant, and permitting data export where such data exists in electronic form. Such results may be provided through one or more webpages, databases, dashboards, or reports.
(c) To update and maintain availability of published reports every 6 months.
(d) To protect the personally identifiable information of private well owners and residents. No publication under this paragraph shall include names, street addresses, parcel identifiers, or other information that directly identifies an individual or specific private property. The department may provide generalized geographic location information sufficient to inform the public of the extent of PFAS contamination.
(e) Nothing in this paragraph shall require retroactive digitization or reformatting of records not maintained in electronic form.
(f) Implementation of this paragraph shall be conducted within existing appropriations and shall not require the development of new sampling or testing programs.
(g) Publication of data under this paragraph shall not be construed as endorsement of analytical conclusions or interpretations.
