ANALYSIS
This bill clarifies the definition of part-time teacher by requiring a superintendent or school principal approval of part-time teachers' expertise to teach in a subject area. The bill also clarifies the ethical standards which part-time teachers must abide by.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT clarifying the definition of part-time teacher.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Part-Time Teacher; Definition; Expertise and Ethics. Amend RSA 189:39-c to read as follows:
189:39-c Part-Time Teacher; Defined.
I. A part-time teacher is not required to hold a state board of education credential provided that the individual:
(a) Works up to 20 hours per week.
(b) Seeks a criminal history record check clearance authorization from the department of education as outlined in RSA 189:13-c prior to receiving a final offer of employment.
(c) Is employed or contracted as a full-time or adjunct faculty member by a university system of New Hampshire or a community college system of New Hampshire member institution.
(d) Has expertise or significant professional experience to teach in a subject-area offered by the school or district or an approved college dual or concurrent enrollment course in the high school that has the same quality and rigor as the courses offered on-campus at the sponsoring college or university, as determined by the superintendent or school principal.
II. [Part-time teachers shall practice the principles identified in the New Hampshire code of conduct and ethics for educational professionals] The professional code of ethics and the professional code of conduct shall apply to all individuals working as a part-time teacher pursuant to this section.
III. Any person who has had an educator credential, educator license, or other educator certification revoked under RSA 189:14-c or RSA 189:14-d, or who has been rendered ineligible to be employed as an educator under another provision of law, shall not be eligible to teach under this section.
IV. The state board of education shall adopt rules pursuant to RSA 541-A to implement this section.
2 Effective Date. This act shall take effect 60 days after its passage.
