STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT establishing a regulatory analysis fund to evaluate the economic impact of proposed rules and making an appropriation therefor.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Regulatory Analysis Fund.  Amend RSA 541-A by inserting after section 41 the following new section:  

541-A:42 Regulatory Analysis Fund.  

I. There is established in the office of the state treasurer a nonlapsing fund to be known as the regulatory analysis fund, which shall be kept distinct and separate from all other funds. The regulatory analysis fund shall assist the joint legislative committee on administrative rules and the general court in determining the economic impact of rules proposed under this chapter on the state's economy.  

II. The joint legislative committee may, by majority vote, authorize the chair, working with the office of legislative services, to hire an external economic analyst to evaluate the impact of rules proposed under this chapter, subject to the availability of funds within the regulatory analysis fund.

III. The treasurer shall deposit into the regulatory analysis fund any funds appropriated by the legislature, as well as any funds transferred by the fiscal committee of the general court, and shall credit any interest or income earned on monies on deposit to the fund.  

2 Appropriation.  There is hereby appropriated from the general fund to the regulatory analysis fund the sum of $1 for the fiscal year ending June 30, 2026. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.  

3  New Subparagraphs; Application of Receipts; Regulatory Analysis Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (410) the following new subparagraphs:  

(411)  Moneys deposited in the regulatory analysis fund as established in RSA 541-A:42.  

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill establishes a nonlapsing fund called the Regulatory Analysis Fund to allow the Joint Legislative Committee on Administrative Rules to contract with external economic analysts for evaluating the economic impact of proposed administrative rules. It includes an appropriation of $1 for FY 2026 to initiate the fund.

 

It is assumed that any fiscal impact would occur after FY 2026.
