Having considered the same, report the same with the following amendment, and the recommendation that the bill as amended ought to pass.

Explanation to Enrolled Bill Amendment to HB 1312

 

This enrolled bill amendment inserts a contingency to incorporate changes made to RSA 310:6, II, if SB 470 of the 2026 regular legislative session becomes law.

 

 

Enrolled Bill Amendment to HB 1312

 

Amend the bill by replacing all after section 12 with the following:  

 

13  Office of Professional Licensure and Certification; Rulemaking Authority. Amend RSA 310:6,

II to read as follows:  

II.  Such organizational and procedural rules necessary to administer the boards in the office, including rules governing the administration of complaints and investigations, hearings, disciplinary and non-disciplinary proceedings, expungement of disciplinary action, manufactured housing dispute resolution, inspections, payment processing procedures, board subcommittees, and application procedures.  For purposes of this paragraph, "manufactured housing dispute resolution" means a program for the timely resolution of disputes between manufacturers, retailers, and installers of manufactured homes, including the issuance of appropriate orders, regarding responsibility for the correction or repair of defects in manufactured homes for defects that are reported during the one-year period beginning on the date of installation.  

14  Contingency.  If SB 470 of the 2026 regular legislative session becomes law, section 4 of this act shall not take effect and section 13 of this act shall take effect 60 days after its passage.  If SB 470 of the 2026 regular legislative session does not become law, section 4 of this act shall take effect 60 days after its passage and section 13 of this act shall not take effect.  

15  Effective Date.

I.  Sections 4 and 13 of this act shall take effect as provided in section 14 of this act.

II.  The remainder of this act shall take effect 60 days after its passage.
