ANALYSIS

 

This bill:

 

I.  Broadens the definition of “antique” vehicles to include all motor vehicles, trucks of any weight, motorcycles farm tractors, and retired fire apparatus that are more than 25 years old regardless of how they are used or maintained.

 

II.  Removes any restriction on daily use, commercial use, or operational purposes.

 

III.  Removes any requirements that such vehicles be maintained only for exhibition, parade use, club activities, or be kept in original or restored condition.

 

IV.  Allows every type of vehicle, regardless of weight or purpose, to become eligible for "antique" status so long as it is more than 25 years old.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to antique motor vehicles.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Antique Motor Vehicle, Farm Tractor, Retired Fire Apparatus, or Motorcycle.  Amend RSA 259:4 to read as follows:  

259:4 Antique Motor Vehicle, Farm Tractor, Retired Fire Apparatus, or Motorcycle. "Antique motor vehicle, farm tractor, retired fire apparatus, or motorcycle" shall mean any motor vehicle, including a truck regardless of its weight, over 25 years old[, and in the case of a retired fire apparatus, over 20 years old, which is maintained for use in exhibitions, club activities, parades, and other functions of public interest, but not for use in commerce. For the purposes of this section, "maintained for use" shall mean a motor vehicle, retired fire apparatus, or motorcycle in its original condition or restored to original or better condition and not intended for daily use]. For the purposes of this section, "antique" shall not impose any restriction on use or operation beyond those generally applicable to all motor vehicles under state law.

2  Repeal.  RSA 266:33, relative to antique vehicle exemptions, is repealed.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

The Department of Safety states this bill would allow approximately 75,000 additional vehicles, that are currently registered under other plate types, to qualify for antique registration. Of the 75,000 vehicles that would be newly qualified, about 35,670 currently hold a passenger-style registration.  Passenger vehicle registration fees range from $42 to $66 per year, depending on vehicle weight, and heavier vehicles are charged at a rate of $1.06 per hundred pounds of gross weight.  The current state registration fees for antique vehicles are significantly lower than standard registration fees ($6.00 per year for vehicles). The Department states if all 75,000 vehicles opted for an antique registration, the potential decrease to state highway fund revenue would be between $2,700,000 and $4,500,000 per fiscal year (a $6 registration fee paid rather than a registration fee of $42 to $66).  Also, pursuant to RSA 235:23 (“Apportionment A”), 12 percent of highway fund road toll and motor vehicle fee revenue collected is distributed to municipalities in the year following collection, therefore, this bill would also reduce state expenditures and local revenue, beginning in FY 2028, of up to $324,000 to $540,000 per year.
