ANALYSIS

 

This bill requires any county, municipality, or other political subdivision of this state that has entered into an agreement with the United States Immigration and Customs Enforcement through the federal 287(g) program to submit a quarterly report to the attorney general.  The attorney general is required to submit a quarterly consolidated report based on the information received.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT requiring quarterly reports from counties, municipalities, or any other political subdivisions of the state that enter into certain agreements with the federal government concerning assistance with federal immigration enforcement.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Participation in Federal Immigration Programs; Report Required.  Amend RSA 106-P by inserting after section 1 the following new section:  

106-P:2  Report Required.  

I.  Any county, municipality, or other political subdivision of this state that has entered into an agreement with the United States Immigration and Customs Enforcement through the federal 287(g) program pursuant to 8 U.S.C. section 1357(g) shall be required to submit a quarterly report to the attorney general, which includes measurable program results and a detailed accounting of program funding and uses.  The first report shall be submitted on or before December 31, 2026.  The report shall include the following categories: persons detained for any civil immigration violation, persons cited for any state offense if any, persons subjected to a field stop or warning for any state offense, and the length of any detention for any civil immigration violation.  For persons in each of the categories, the aggregate data shall also include the municipality and country where each such person resides.  For persons who are detained, the report shall also include the race of such persons to the extent such information is indicated on the complaint, summons, or citation.  

II.  The attorney general or their designee shall submit a quarterly report to the governor, senate president, speaker of the house of representatives, county commissioners, and executive committees of each county summarizing the information received under this section from any county, municipality, or other political subdivision.  The first report from the attorney general shall be submitted on or before February 1, 2027.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires municipalities, counties, and any other political subdivision that enters into an agreement with United States Immigration and Customs Enforcement (ICE) under the 287 (g) program to submit quarterly reports to the Attorney General starting on December 31, 2026. Additionally, the Attorney General is required to submit a quarterly consolidated report summarizing information received from municipalities, counties, and any other political subdivision starting on February 1, 2027.

 

The New Hampshire Department of Justice indicates that one additional part-time investigative paralegal would be required to meet the bill’s reporting obligations.  The estimated total costs for this position are: FY 2027 $63,000, FY 2028 $62,000, and FY 2029 $64,000.  This bill does not provide funding, nor does it authorize new positions.  

 

The New Hampshire Municipal Association (NHMA) notes that if municipalities are required to report new data not currently collected, the cost to compile such information would be less than $10,000 per political subdivision.

 

The New Hampshire Association of Counties (NHAC) anticipates minimal costs to comply with the bill.  Some counties may already be able to generate the required reports using existing software, while others may incur only minor expenses to compile the necessary data.
