1 New Paragraphs; Aligning Hours. Amend RSA 100-A:1 by inserting after paragraph XXXIV the following new paragraph:

XXXIV-a.(a) Notwithstanding paragraph XXXIV or any other provision of law to the contrary, a retired member of the retirement system who was employed in a position qualifying for the higher grandfathered hourly limit under 2018, 293:6 (HB 561) and who retired prior to January 1, 2019, shall retain the right to work up to 1,664 hours per calendar year for any participating employer, provided that:

(1) The retiree had been employed in a part-time position or positions at the 1,664-hour limit as of January 1, 2019;

(2) The retiree continues to be employed by one or more participating employers without a break in part-time employment greater than 28 days; and

(3) The change of employment does not include reinstatement to a position requiring mandatory membership under RSA 100-A:3.

(b) For purposes of this paragraph and provided that the retiree meets the conditions of RSA 100-A:1, XXXIV-a, the grandfathered hourly limit shall continue to apply to successive part-time positions with participating employers, regardless of changes in job title, duties, or employing entity.

2 Effective Date. This act shall take effect 60 days after its passage.
