STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraphs; Aligning Hours. Amend RSA 100-A:1 by inserting after paragraph XXXIV the following new paragraph:
XXXIV-a.(a) Notwithstanding paragraph XXXIV or any other provision of law to the contrary, a retired member of the retirement system who was employed in a position qualifying for the higher grandfathered hourly limit under 2018, 293:6 (HB 561) and who retired prior to January 1, 2019, shall retain the right to work up to 1,664 hours per calendar year for any participating employer, provided that:
(1) The retiree had been employed in a part-time position or positions at the 1,664-hour limit as of January 1, 2019;
(2) The retiree continues to be employed by one or more participating employers without a break in part-time employment greater than 28 days; and
(3) The change of employment does not include reinstatement to a position requiring mandatory membership under RSA 100-A:3.
(b) For purposes of this paragraph and provided that the retiree meets the conditions of RSA 100-A:1, XXXIV-a, the grandfathered hourly limit shall continue to apply to successive part-time positions with participating employers, regardless of changes in job title, duties, or employing entity.
2 Effective Date. This act shall take effect 60 days after its passage.

*The New Hampshire Retirement System states it is not able to separate the fiscal impact of this legislation between county and local government, therefore the fiscal impact is shown together as political subdivisions.
METHODOLOGY:
This bill allows retirees who were already working part-time at the higher grandfathered limit of 1,664 hours per year as of January 1, 2019, to retain that limit even if they change positions or employers, provided there is no break in part-time employment longer than 28 days and the new position does not require mandatory New Hampshire Retirement System (NHRS) membership.
NHRS states that this change would expand the flexibility for “grandfathered” retirees to move between part-time positions without losing the higher hour limit. The fiscal impact is deemed indeterminable because it is unclear how many retirees would take advantage of this provision. No new administrative costs are expected.
It is assumed that any fiscal impact would occur after FY 2026.
