STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT prohibiting the sale of a child's personal data.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subparagraph; Expectation of Privacy; Personal Data.  Amend RSA 507-H:6, I by inserting after subparagraph (e) the following new subparagraph:  

(e-1)  Not sell a child's personal data;

2  Effective Date.  This act takes effect January 1, 2027.

METHODOLOGY:

This bill amends RSA 507-H (New Hampshire’s Data Privacy Law) to prohibit covered entities from selling the location or other sensitive data regarding children.

 

The Department of Justice (DOJ) states this bill will result in an indeterminable impact to state General Fund expenditures beginning in FY 2027.  Under current law, entities must obtain consent before processing a known child’s data and must comply with federal  Children’s Online Privacy Protection Act (COPPA) requirements.  By prohibiting the sale of children’s location and other sensitive data regardless of knowledge or consent, the bill may change investigative patterns for the Consumer Protection and Antitrust Bureau.  DOJ notes that the bill may streamline certain existing investigations but may also increase the number of potential violations requiring investigation and enforcement.

 

Because DOJ cannot predict the number of additional investigations or enforcement actions that may result, the Department states the fiscal impact is indeterminable, but could be more than $10,000 – $100,000 or less in any fiscal year.
